TERMS AND CONDITIONS for Infomercial Business Partners: By participating as an exhibitor in the Association of Rocky Mountain College and University Mail Services (ARMCUMS) Infomerical Program, you, your company, and your company representatives agree to the following terms and conditions. These terms and conditions will be strictly enforced, and violators may be subject to immediate termination of their infomercial and subsequent posting of said infomercial on the ARMCUMS website. This may impair their exhibit opportunities through future ARMCUMS programs.
INFOMERCIAL MANAGEMENT: The program is organized and managed by the Association of Rocky Mountain College and University Mail Services (ARMCUMS). Any matters not covered in these Rules and Regulations are subject to the interpretations of the ARMCUMS Board of Directors, and all exhibitors must abide by their decisions. ARMCUMS shall have full power to interpret, amend, and enforce these rules and regulations, provided any amendments, when made, are brought to the notice of exhibitors. Each exhibitor, for themselves and their employees, agrees to abide by the foregoing rules and regulations and by any amendments or additions thereto. ARMCUMS reserves the right to determine, at its sole discretion, the eligibility of any company or product for inclusion in the program.
EXHIBITOR APPLICATION PROCESS: Business Partners who submit their applications and payment by August 15, 2020 will be given preferred placement assignments based on available dates/times in order of registration date. All registrations received after August 15, 2020 will be assigned remaining dates/times at the sole discretion of the ARMCUMS Board. Each exhibiting company will receive an e-mail or letter of confirmation. It is the responsibility of the company contact to disperse exhibit information, along with these rules and regulations, to the appropriate company representatives. ARMCUMS reserves the right to exercise its sole discretion in the acceptance or refusal of applications.
SUBLEASING OF EXHIBIT TIME: Exhibitors may not assign, sublet or apportion to others the whole or any part of the time allocated. Exhibitors may not display goods or services other than those manufactured or regularly distributed by them. Subsidiary companies, whether wholly or partially owned, may not be combined with or share space with a parent company and each subsidiary company must register separately to purchase its own Infomercial date/time.
REFUNDS/ CANCELLATION: All exhibit time cancellation requests, must be submitted in writing to the ARMCUMS Infomercial Representative at [email protected]. If written notice of cancellation is received 15 days before scheduled infomercial, a full refund, less an administrative fee of $20, will be issued. For written cancellations received less than 15 days before scheduled infomercial, no refunds will be issued if infomercial is cancelled. In the event that an act of God or other causes beyond the control of ARMCUMS causes the exhibit to be cancelled, full refund of the exhibit fees will be made, which is the limit and extent of ARMCUMS’ liability for such cancellation. ARMCUMS shall not be held liable for failure to hold the ARMCUMS Infomercial/Exhibit as scheduled.
FAILURE TO EXHIBIT: Should any exhibitor fail to exhibit or present their infomercial on their scheduled day/time, they forfeit all fees paid.
EXHIBITOR REPRESENTATION: Exhibit/infomercial fee includes registration for one (1) representative. If additional representatives are needed beyond the first one, an additional fee will be applicable. Additional representatives must prepay the Additional Representative registration fee. There will be a limit of three (3) representatives per Infomercial purchased in the ARMCUMS Infomercial Program. Only paid, registered representatives will be allowed in the ARMCUMS Infomercial/Exhibit.
CONDUCT: All exhibits/Infomercials will be to serve the interest of ARMCUMS members and will be operated in a professional manner. The ARMCUMS Infomercial Representative and/or Board reserves the right to request the immediate withdrawal of any exhibit/infomercial that ARMCUMS believes to be injurious to the purpose of the Association. ARMCUMS reserves the right to refuse to continue the infomercial at any point due to any objectionable or undesirable manner exhibited. The use of sideshow tactics or other undignified methods considered by ARMCUMS to be objectionable are expressly prohibited in the exhibition/infomercial.
GIVEAWAY or PRIZES: Promotional giveaways and exhibitor prize raffles will be permitted and must be coordinated with ARMCUMS Infomercial Representative in advance. The information regarding any giveaways or prizes may be used by ARMCUMS as advertising incentives prior to your scheduled infomercial. All materials are expected to be of a professional nature. ARMCUMS reserves the right to disallow any materials, prizes or give-away items that they believe to be inappropriate. The cost to ship any said giveaways or prizes is the sole responsibility of the Business Partner. Shipping Information must be provided by the ARMCUMS attendee directly to the Business Partner.
RECORDING: Recording of Infomercials may be conducted by either the Business Partner or ARMCUMS. If the Business Partner chooses to record the infomercial, they are required (1) to have recording platform and file type preapproved by the ARMCUMS Infomercial Representative, 2 weeks prior to infomercial (2) to submit said recording to ARMCUMS within 24 hours of completion of the infomercial, in order to have it posted on the ARMCUMS website. Recordings may be used in promotional pieces and shall be the sole property of ARMCUMS once posted.
ARMCUMS PLEDGE: ARMCUMS pledges to retain the posting of your paid infomercial on their website, accessible to everyone and not password protected, for the term of 6 months from the date originally posted. Business Partners are welcome to direct others to the ARMCUMS website to view the infomercial.
PRESIDING RULES: The presiding rule of the Infomercial Program is to be considerate of attendees, other exhibitors, Infomercial Program staff and any possible guests. Respectful treatment of other exhibitors and their products is expected.
LIABILITY: Exhibitor assumes responsibility and hereby agrees to protect, indemnify, defend, and hold harmless ARMCUMS and any of its boards, officers, employees, volunteers, infomercial attendees or member institutions against all claims, losses, and damages to persons or property, governmental charges or fines, and attorney fees arising out of or caused by Exhibitor’s Infomercial presentation or a part thereof, excluding any such liability caused by the sole negligence of ARMCUMS, their board or agents.
VIOLATIONS: Violation of any Rules and Regulations by the exhibitor or his or her employees or agents shall, at the option of ARMCUMS, forfeit the exhibitor’s right to present their exhibit/infomercial and such exhibitor shall forfeit to ARMCUMS all monies paid or due. Upon evidence of violation, ARMCUMS may cancel any scheduled infomercial and/or remove any said infomercial from their website. The exhibitor shall pay all expenses and damages that ARMCUMS may incur thereby.
SEVERABILITY: All agreements and covenants contained herein are severable, and in the event any of them shall be held to be invalid by any competent court, this agreement shall be interpreted as if such invalid agreements or covenants were not contained herein.
ENDORSEMENTS: Having an exhibitor relationship with ARMCUMS does not indicate that ARMCUMS endorses the product or service of said exhibitor.
